Web Terms of Use Agreement & Privacy Policy


Owl Suites, Inc. (“OWLS”) owns the web site accessible at owlsuites.com and lawofficespace.com (collectively, the “Site”) which is designed to provide online marketing and administrative services to connect independent attorney members of OWLS in need of work and/or meeting space (“Members”) with independent facilities offering such space (“Host Locations”) and related information and services (collectively, the “Services”).

This Web Terms of Use Agreement (this “Agreement”) describes our policies and practices while you are using the Site and the Services.  Your use of this Site indicates your agreement to be bound by our Privacy Policy and by this Agreement.

  1. Notice

OWLS has the right at any time to change or discontinue any aspect or feature of the Site including, without limitation, the content and software needed for access or use of the Site.  By agreeing to use this Site and its Services, you understand and agree to all terms and conditions of this Agreement.  All changes to this Agreement will be binding on you 14 calendar days after they are initially posted on the Site unless you have not downloaded the Site, in which case they are binding on you immediately.

  1. Intended Use

 This Site is intended for your benefit; to learn more about OWLS; to use it to post and/or learn about work and meeting space availability at Host Locations.

You understand that OWLS does not accept any liability whatsoever for any harm that might result from any statements presented on the Site, including third-party advertisements posted on the Site.

You understand that any statements by OWLS, its employees, agents, and affiliates are provided for informational purposes only.

OWLS relies on Members to provide accurate information, and is not responsible for false or incomplete Member information.

OWLS relies on Host Location to provide accurate information, and is not responsible for false or incomplete Host Location information.

OWLS provides online marketing and administrative services only. OWLS does not lease property nor provide services or products outside the State of Texas.  Regardless of where the Member is located, all Members should be considered Members of the OWLS Texas business location only. OWLS has no locations, employees, agents or operations outside the State of Texas, USA.

  1. Restriction on Use

You must be at least 18 years of age to use this Site.  You agree to be solely responsible for maintaining control over the use and/or access to the Site by minors in your family.

  1. Use of Information and Materials

Unauthorized use of our Site and systems, including but not limited to misuse of any information posted on the Site, is strictly prohibited.

  1. Claims of Copyright or Trademark Infringement

The Digital Millennium Copyright Act (the “DMCA”) provides recourse for copyright owners who believe that material appearing on the Internet infringes their rights under U.S. copyright law.  OWLS also reviews claims of trademark infringement.  If you believe in good faith that materials hosted by OWLS infringe your copyright or trademark rights, you (or your agent) may send us a notice requesting that the material be removed, or access to it blocked.  The notice must include the following information:  (a) a physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; (b) identification of the copyrighted work or trademark claimed to have been infringed (or if multiple copyrighted works or trademarks located on the Site are covered by a single notification, a representative list of such works); (c) identification of the material that is claimed to be infringing or the subject of infringing activity, and information reasonably sufficient to allow OWLS to locate the material on the Website; (d) the name, address, telephone number, and email address (if available) of the complaining party; (e) a statement that the complaining party has a good faith belief that the use of the material in the manner complained of is not authorized by the copyright or trademark owner, its agent, or the law; and (f) a statement that the information in the notification is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.  Please be advised that OWLS will not respond to complaints that do not meet these requirements.  If OWLS determines that the materials alleged to infringe your copyright or trademark rights do not require removal, OWLS will remove those materials only pursuant to a court order declaring the content or use of the materials unlawful.

If you believe in good faith that a notice of copyright infringement has been wrongfully filed against you, the DMCA permits you to send us a counter-notice.  Counter-notices must include the following information:  (a) your name, address, and telephone number; (b) the source of the content that was removed; (c) a statement under penalty of perjury that you have a good faith belief that the content was removed in error; (d) a statement that you consent to the jurisdiction of Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which OWLS may be found, and that you will accept service of process from the person who provided the original complaint; and (3) a physical or electronic signature (for example, typing your full name).

Notices and counter-notices with respect to the Site must meet the then-current statutory requirements imposed by the DMCA (see http://www.loc.gov/copyright for details) and should be sent to the agent identified below.  We suggest that you consult your legal advisor before filing a notice or counter-notice.  Also, be aware that there can be penalties for false claims under the DMCA.

  1. Enforcement

Limitation of Warranties and Remedies. To the full extent allowed by law, OWLS disclaims all warranties, terms, or conditions, express or implied, either in fact or by operation of law, statutory or otherwise, including warranties, terms, or conditions of merchantability, and fitness for a particular purpose.  OWLS neither assumes nor authorizes any other person to assume for it any other liability in connection with the sale and use of the services on the Site.  In no event will OWLS be liable for any incidental, consequential, punitive or special damages, including, without limitation, lost profits or revenues, even if OWLS has, or should have had, any knowledge, actual or constructive, of the possibility of such damages.

Indemnity.  You agree to defend, indemnify, and hold harmless OWLS and its officers and employees (the “OWLS Parties”) against any and all third party claims, suits, costs, losses, liabilities, and expenses of any kind (including reasonable attorneys’ fees) that OWLS may incur arising out of or resulting from the use of the Site or any of the services of OWLS.

Choice of Law and Venue. This Agreement will be construed and governed in accordance with the laws of the State of Texas without application of choice-of-law provisions that would require application of the laws of another jurisdiction.  By entering into this Agreement, all parties irrevocably submit themselves to the exclusive venue and personal jurisdiction of the state and federal courts of Rockwall County, Texas with regard to any dispute relating to this Agreement or its enforcement.

Severability.  If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of any of the remaining provisions will not in any way be affected or impaired and a valid, legal, and enforceable provision of similar intent and economic impact will be substituted therefore.

Additional Provisions Regarding Liability. You and OWLS agree that the following limitations will not be read so as to limit any liability to an extent that would not be permitted under applicable law and specifically will not limit any liability for gross negligence, intentional tortious, or unlawful conduct or damages for strict liability that may not be limited by law.

Notices. Any notices or communications sent by you to OWLS pursuant to this Agreement must be in writing and sent to the address specified herein or such other address as OWLS may specify in writing.  All notices must be sent to:  contact@owlsuites.com and must contain the word “NOTICE” in the subject line.

  1. Additional Information

The Site may contain links to other sites.  However, please be aware that OWLS is not responsible for and cannot control the terms of use and conditions of such other sites.  We encourage you to be aware when you leave the Site, and to read the terms of use of each and every website or application.  This Agreement applies solely to this Site.  We are not responsible for the content, accuracy, or opinions expressed in such web sites or applications.  Inclusion of any linked web sites on our Site does not imply approval or endorsement of the linked web site by us.

Plugins/Third Party Applications. OWLS may, in its sole discretion, provide you with access to third-party applications through the Site via links of which interface with OWLS application programming interfaces (“OWLS APIs”) (for purposes of this Agreement, all such third-part applications are “Third Party Apps”).  Such Third Party Apps are not endorsed by OWLS. Use of such Third Party Apps by you is voluntary.  Use at your own risk.  OWLS makes no representations or warranties regarding your use of any Third Party Apps, which shall be governed by a separate agreement between you and the owners of such Third Party Apps.  You agree that OWLS has no liability whatsoever for the Third Party Apps, including, without limitation, providing continued access to the OWLS APIs, technical issues related to the Third Party Apps or their interaction with the OWLS APIs, and any damages or claims caused by or arising out of the Third Party Apps.  OWLS may change, suspend, or discontinue any aspect of the OWLS APIs at any time, including the availability of any OWLS APIs. OWLS may also impose limits on certain features and services or restrict Third Party App’s access to parts or all of the OWLS APIs or the OWLS Site without notice or liability.

OWL Suites, OWLS, Lexi the Owl (and related designs), lawofficespace.com, owlsuites.com, the OWLS logo (in all forms), “Space Alchemy” and other slogans, and all page headers, custom graphics, and button icons are service marks, trademarks, and/or trade dress of OWLS.  All rights are reserved.  All other trademarks appearing on the Site are the property of their respective owners.

Copyrights. The Site contains copyrighted materials and other proprietary information, including, without limitation, downloadable files, text, software, photos, video graphics, music, and sound.  The contents of the Site are protected under the United States copyright laws.  You may not modify, publish, transmit, display, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part.  No copyright, redistribution, retransmission, publication, or commercial exploitation of downloadable material will be permitted without the express written permission of OWLS and the copyright owner.

Representations and Warranties. By using the Site, you represent and warrant that you are using the Site solely for personal reasons and that you are not an attorney or an agent of an attorney conducting an investigation to a potential claim related to the Site, any materials available through the Site, or OWLS.  You also represent and warrant that you are not engaging in activities in an attempt to circumvent, or make any efforts thereto, any encryption, password protection, or security features placed within the Site or any subpart thereof, or reverse engineer any part of the Site, portions of the Site, or any material available through the Site.

Privacy Policy

At OWL Suites, Inc. (“OWLS”), we believe it is important to protect and respect the privacy of our customers and visitors to our website, www.owlsuites.com and affiliated sites, forwards and redirect sites (the “Site”).  We are committed to ensuring your privacy as a guest and a customer as set forth below, and we know you care about how your personal information is collected, used, and shared.

This Privacy Statement describes our policies and practices in the areas of:  Collected Information, Security, and Enforcement.  We urge you to read this Privacy Policy so that you will understand both our commitment to you and your privacy, and how you can participate in that commitment.

General.  In general, you can browse the Site without telling us who you are or revealing any personal information about yourself.  We will ask you when we need information that personally identifies you or allows us to contact you (“Personal Information”).  Generally, this information is requested when you contact us for information or sign up for our online marketing or administrative services (“Services”).  We use your Personal Information for the following primary purposes:

  • To facilitate the marketing and delivery of our Services.
  • To make our Site easier for you to use by not having to enter information more than once.
  • To help you quickly find information on the Site.
  • To alert you to special offers, updated information and other services from our company, affiliates, and business partners.
  1. Collected Information.  OWLS may collect information from you in several different ways including the following:

Registration. When you register for an account or sign up as a member of Host Location, you are required to give certain personally identifiable information, such as your name, address, e-mail address, phone number, and where applicable, banking/credit card and other billing information to OWLS of to a third party vendor (“Third Party Vendor”).  We use this information to contact you about the Services and services on our Site in which you have expressed interest and to facilitate further Services.  OWLS is not liable for the privacy of your information provided to such Third Party Vendors, so you must review their privacy policy before providing such information.

Order.  If you sign up for a Service, we request certain personally identifiable information from you on our order form.  You must provide contact information (such as name, e-mail, and address) and, where applicable, financial information (such as credit card number, expiration date).  We use this information for billing purposes and to fulfill your orders.  If we have trouble processing an order, we will use this information to contact you.

Requests. When you request information from us, by phone or e-mail, through the Site, or by requesting to join our mailing list, we may collect certain personally identifiable information from you.  If you respond to a survey or sign up contest or drawing, we may request certain Personal Information. We use this information to provide you with information, customer service, or other services related to your request.

Log Files.  As is true of most websites, we gather certain information automatically and store it in log files.  This information includes Internet Protocol (IP) addresses, browser type, Internet Service Provider (ISP), referring/exit pages, operating system, date/time stamp, and movements around the site, and to gather demographic information about our user base as a whole.  We do not link this automatically-collected data to personally identifiable information.

Correspondence.  If you send us personal correspondence, such as an email or letter, we may collect such information into a file specific to you.

Third Party Referral.  We may collect certain personally identifiable information regarding you when a third party may voluntarily provides such information, such as when using a “Send To A Friend” option with respect to our communications.

 Public/Sponsored Events. OWLS participates in many public events and events with multiple sponsors, such as trade shows and seminars.  The events generally collect certain personally identifiable information from all attendees and distribute this data in whole or in part to all the event sponsors including OWLS.  While we cannot control and are not responsible for the practices of other sponsors for these events, OWLS will maintain the privacy of its copy of your personal information received in this way.

Site Usage. OWLS may monitor your activities, preferences, and transactional data (such as your IP address) relating to your use of the Site and/or services and log this information.  This information may be used to diagnose Site technical problems.  We also use personal and non-personal information in aggregate or statistical form in order to improve our Services, services and procedures. This means that information from many persons and/or web site visits is grouped together in a way that does not disclose the personal information of any particular person.  For example, we track how many people have expressed interest in a particular Service and what kinds of web browsers are most often used when visiting our web site.  Among other things, this information helps us determine which of our Services and services are successful and which should be changed or discontinued.

Cookies are data files that are written onto your computer by a website, and stay there unless they expire or are removed by you.  Cookies enable us to recognize your computer when you revisit the Site, and recall your Site preferences to enhance your experience in using the Site.  We do not use cookies to collect or use any information about your visits to other websites and do not knowingly allow any third party to create cookies or otherwise collect any information from our Site.  Consult your browser Help menu to learn more about how you can configure your browser software to notify you when your computer receives a new cookie.  Note that you may also be able to configure your browser to disable the creation of cookies entirely (although your full interactive use of the Site may be adversely impacted if you do this.  For example, you may not be able to place on-line orders for our Services.)  This Privacy Policy covers the use of cookies by this Site only and does not cover the use of cookies by any advertisers or third parties.

Web Beacons. Web beacons are very small, invisible graphics present on web pages or emails that help us track when the page or email has been accessed. Some parts of the Site, emails and other files may use web beacons, also known as clear gif technology or action tags. We do not use web beacons to collect, use or store any Personal Information about you.

Customer Service. Based upon the personally identifiable information you provide us, we may send you a confirmation e-mail to act as a receipt of your purchase.  We will also communicate with you in response to your inquiries and to provide the services you request.

  1. Disclosure of Collected Information

 Information from the Site. OWLS may disclose to our strategic partners your e-mail address, phone number, browsing activity, and/or other personal information, that we collect via the Site.  We reserve the right to outsource certain activities such as mass mailings, order fulfillment, shipping and credit card processing, on a limited basis, to certain third parties.  In such cases, we strictly limit the information provided to these third parties to the minimum necessary for them to perform the functions for which we have retained them and prohibit them from using the information for any other purpose or retaining it after it is not longer needed.

Cooperation with Legal Authorities.  OWLS, however, will cooperate with official law enforcement inquiries, such as fraud investigations, subpoenas, and government inquiries and request, and will disclose your information when necessary to comply with state and federal laws and regulations.

Disclaimer. We cannot ensure that all of your private communications and other personal information will never be disclosed in ways not otherwise described in this Privacy Policy. By way of example (without limiting the foregoing), we may be forced to disclose personal information to the government or third parties under certain circumstances, third parties may unlawfully intercept or access transmission or private communications, or users may abuse or misuse your personal information that they collect from the Site.

 Use Limited to Adults Over the Age of 18.  This Site is not for use for anybody under the age of 18.  By using this Site, you verify that you are over the age of 18 and in compliance with this provision.

OWLS is committed to ensuring that your information, including your customer and financial information, is protected while you are on the Site. OWLS uses appropriate and reasonable measures to maintain the security of your personal information.  This includes procedures followed by our personnel to prevent data loss or theft, physical security of our servers and information stores and electronic security such as firewalls, password-protected databases and secure connections.

OWLS may use certain third parties for services such as advertising, marketing and order fulfillment.  We only work with third parties whose privacy policies and security practices are equal to or more stringent than our own and who agree to strictly limit their use of the information we provide them to fulfill the functions for which they have been retained.

You should be aware, however, that no data transmitted over the Internet, sent through the mail or stored on a computer is 100% secure and that we cannot guarantee the security of your personal data while in transmission to us.  Public computers in particular should never be considered secure.  You should never give out personal information on message board, in chat rooms and other publicly-viewable locations.

In addition, there exist malicious programs, typically called computer viruses or trojan horses, which can be used to capture information off your computer’s hard drive or while you are entering it into a web form or sending it by email.  You should always use the appropriate anti-virus and personal security technology to protect yourself.  Lastly, if you have been assigned a login ID and/or password for use on a OWLS system (for example, a login for our web store to purchase Services), you should never give out that information to others.

If for some reason you believe OWLS has not adhered to the principles of this Privacy Statement, please notify us, and we will do our best to determine and correct the problem promptly.

Links.  The Site may contain links to other sites.  However, please be aware that OWLS is not responsible for and cannot control the privacy policies of such other sites.  We encourage you to be aware when you leave the Site, and to read the privacy statements of each and every web site that collects personally identifiable information.  This Privacy Statement applies solely to information collected by the OWLS Site.

Notification of Privacy Statement Changes.  We reserve the right to change this Privacy Policy at any time, and you may visit this page to learn of our revised Privacy Policy.  All such changes shall be binding on you 14 calendar days after they are initially posted on the Site unless you are a new user, in which case they are binding on you immediately.

 Choice/Opt-Out  Any customer may opt out at any time by using the Opt-Out or Unsubscribe option at the bottom of most of our mass email communications, or by contacting us through the “Contact Us” section of the Site.

 Access to Personal Information.  If your personally identifiable information changes, or if you no longer desire some or all of our services, you may correct or update it by contacting us.

 Business Transition.  In the event we go through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of our assets, your personally identifiable information will likely be among the assets transferred.
